The first 10 word marks were registered en bloc on 30.09.2009. An 11th trademark, coincidentally precisely MISA's pièce de résistance - SEXUAL CONTINENCE - was registered only on 20.10.2009. 

On 25.10.2010 a 12th trademark was registered - AMOROUS CONTINENCE. Nothing but a synonym, a kind of "lovewashing" of the SEXUAL CONTINENCE. Because - right? - The MISA follower, led by the "guru from Tărtășești", is not having sex, but love.

On the new MISA website there is even a "merger" of the two trademarks, "SEXUAL AMOROUS CONTINENCE", not yet officially registered.


The rights conferred to MISA in Romania by the registration at OSIM of the above trademarks extend ONLY - we repeat - ONLY - to the goods and services applied for by MISA in the list attached to each trademark and apply only in the case of commercial activities. Details of the legislation in force here.

For example, for the trademark registered under the name MISA, MISA has in Romania rights ONLY in relation to:

- CDs and DVDs of cultural information, philosophical, parapsychological education,
yogic and naturopathic.
- Paper, cardboard and goods made from these materials, not included in other classes; printed matter; bookbinding articles; photographs; stationery; adhesives (sticky materials) for stationery or household purposes; artists' materials; brushes; typewriters and office requisites (except furniture); instructional or teaching materials (except apparatus); plastic materials for packaging (not included in other classes); typefaces; clichés.
- Advertising; commercial business management; commercial administration; office work; import-export, chain stores.
- Education; training; entertainment; sporting and cultural activities.

If - absurdly, of course - a company in Romania were to sell wigs, fridges or pretzels under the MISA trademark, it would not infringe the rights of "Europe's largest yoga school" protected by the MISA trademark registration.

As regards the ExMISA blog, MISA management's demands to remove references to MISA from this blog are therefore legally unfounded in several respects.

1. ExMISA is not a company and does not carry out commercial activities.

2. ExMISA not only does not market, but does not offer free of charge "products or services identical" to those of MISA and therefore cannot "present a risk of confusion with it". (Article 102)

3. MISA may not prohibit the use of the name MISA (even if it is a registered trademark) when it identifies or refers to "its goods and services" (point c) or which relate to "kind, quality, purpose, value" (point b).
On "taking advantage of the reputation of the trade mark", see how MISA's own subsidiaries shy away from being associated with the parent organisation.
The phrase "use of the sign would cause the trade mark proprietor detriment" refers to the marketing of identical goods and services under the MISA trade mark, which would either decrease sales or bring a bad image through inferior quality. (Article 45)

MISA's sales decrease, but not by using identical goods on the blog, but by unmasking MISA.
