MISA was illegally founded based on gross forgery

MISA was founded based on an approval declared false by the Bucharest Court of Appeal. Gregorian Bivolaru escaped legal consequences because the statute of limitations for criminal liability had expired.

It is not the purpose here to establish if there is the need of formal approvals for teaching yoga or not. The focus is set just on establishing if MISA was legally founded or not and also if it is functioning on legal bases or based on forgeries.

MISA was declared constituted by the Court Judgement no. 31/23.01.1990 pronounced for the Request no. 34/PJ/1990 addressed to the Bucharest, Sector 1 – Territorial Court by Gregorian Bivolaru (president of the newly constituted association).

The request included a document (no. 3457/19.01.1990) apparently given by The Ministry of Health – The Commission for the Study of Yoga and Parapsychology, signed by a certain Dr. Alexandru Mircea Rădulescu as president of the commission. This document stated that Gregorian Bivolaru was authorized to teach theoretical and practical yoga courses as “yoga instructor”.

The Ministry of Health stated in a memo (posted below) from 2003 that this commission never existed. The stamp on document no. 3457/19.01.1990 is not that of the Ministry of Health, but of the Hospital Sfântul Pantelimon, where Dr. Alexandru Mircea Rădulescu was employed as a specialist psychiatrist.

Further on the document in question was declared false by Resolution No 500/P/1999 of 07.04.2003 of the Bucharest Court of Appeal.
However, the court ordered that the criminal proceedings against Gregorian Bivolaru should not be initiated for the offences provided for in Articles 288, 290 and 291 of the Criminal Code, as the limitation period for criminal liability had expired. 

According to Art.288 C.C. - Material forgery in official documents is punishable by imprisonment from 3 months to 3 years.
According to Art.290 C.C. - Forgery of private documents is punishable by imprisonment from 3 months to 2 years or a fine.
According to Art.291 C.C. - Forgery is punishable by imprisonment from 3 months to 3 years when the document is an official document, and by imprisonment from 3 months to 2 years or a fine when the document is under private signature.

1. There were checked the Orders of MH beginning with 1970 about the existence within the Ministry of Health of the Yoga Commission.
In the Ministry of Health never existed and does not exist a Yoga Commission founded on an order of the Minister of Health.

... states the following: 

1. Document nr. 3457/19-th of February 1990

    a) the number for the document is taken from the Patients Survey Register of Dr. Alexandru Mircea Rădulescu, employee of the St. Pantelimon Hospital as Psychiatric specialized doctor at the Adults Polyclinic Hospital.
    b) At the time when the document no. 4357/1990 was issued in the Ministry of Health didn’t exist the Yoga Commission which authorized Bivolaru Gregorian as yoga instructor to teach theoretical and practical yoga courses.
    c) The stamp applied over Dr. Rădulescu's signature is the one of St. Pantelimon Hospital and not of the Ministry of Health."

CONCLUSION
The Ministry of Health did not authorize the Commission of Yoga and Parapsychology, did not approve the registration of" MISCAREA SPIRITUALA DE INTEGRARE IN ABSOLUT" as a juridical organization.

Mişcarea Spirituală de Integrare în Absolut (MISA) acts without the approval of the Ministry of Health, so there can be no question of a “coordination” by the Ministry of Health.

So there you have it, MISA has already gone wrong at its foundation. It used lies, violated SATYA - yoga's golden rule of truth.
That's how it started and unfortunately that's how it's still going on - entangling itself in lies.
